In forty years of practice as an active criminal defence lawyer, it has been revealed that an argumentative approach is best suited to observe the interests of the defended clients in the most effective manner. Only if it is possible to convince the public prosecution or the court of the correctness of the legal position in favour of the client, only when it is possible to convince the public prosecution or the court of the necessity of elucidating all facts speaking in favour of the client, then the optimal defence result can be attained for the client. However, if there is no willingness to take note of the arguments of the defence, if there is no willingness to reconsider a preconceived opinion, if there is no willingness to respect the rights of the defendant, his interests must, where necessary, also be defended in a confrontational manner, with the help of the statutory provisions that are provided for his protection.
